Telemedicine Policy & Informed Consent

Texian Health & Longevity, operated by WhaleyAP LLC, delivers all clinical care by telemedicine. This policy explains how care is delivered, who is eligible, and the standards our provider follows when evaluating and prescribing.
1. Who Provides Your Care
All evaluations are conducted personally by Brett Whaley, MSN, RN, ACNP-BC, Founder & Acute Care Nurse Practitioner. National Provider Identifier (NPI) 1164797643. You will never be evaluated by a call center representative, a chatbot, or an unlicensed staff member. Our provider holds an active, unrestricted license in every state where patients are seen and is licensed in Texas, Florida, Utah, Nevada, and Arizona.
2. Where We Can Treat You
Care may only be provided when you are physically located in a state where our provider holds an active license at the time of your appointment. You must confirm your physical location at the start of every visit. If you have relocated or are traveling outside a licensed state, the visit will be rescheduled.
3. Patient Eligibility
Patients must be 18 years of age or older. We do not treat minors. Certain medical histories, medications, or unmanaged conditions may make a patient inappropriate for telehealth management, in which case we will refer you to in-person care.
4. Identity Verification and Intake
Patient Verification Policy: In accordance with telemedicine regulations, all prospective patients must complete medical intake documentation and verify their identity with a government-issued photo ID prior to evaluation.
5. Technology Used
Video evaluations are conducted via HIPAA-compliant Doxy.me; patient records are managed securely via CarePatron EMR. You will need a device with a camera and microphone and a reliable internet connection in a private setting. Audio-only visits are used only where clinically appropriate and permitted by state law.
6. Standard of Care and Prescribing
A consultation does not guarantee a prescription, and payment for a consultation is payment for the provider's professional time and clinical judgment only. Prescriptions are issued only after a legitimate patient-provider relationship is established through a clinical evaluation, review of your history, and — where clinically indicated — laboratory testing. We do not offer prescribing on demand, and we do not allow patients to select a medication, dose, or quantity independent of clinical evaluation.
7. Controlled Substances
Testosterone is a Schedule III controlled substance. Our provider holds DEA registration MW8654546 (active) and complies with the Ryan Haight Online Pharmacy Consumer Protection Act, the Controlled Substances Act, applicable DEA telemedicine flexibilities, and each state's controlled substance and prescription monitoring program requirements. State prescription drug monitoring databases are queried where required. Controlled substances are never dispensed by this website; they are prescribed only when medically appropriate and are transmitted electronically to a licensed pharmacy.
8. Laboratory Testing and Monitoring
Hormone therapy requires baseline and ongoing laboratory monitoring. Patients who decline required labs or follow-up monitoring may not be continued on therapy. Lab pricing is listed on our Pricing & Consultations page.
9. Risks and Limitations of Telehealth
Telemedicine cannot substitute for a physical examination in all situations. Limitations include the inability to perform hands-on examination, potential technology failures, and delays in care. Information transmitted may, in rare circumstances, be insufficient for sound clinical decision-making, in which case your provider will direct you to in-person evaluation.
10. Emergencies
Texian Health & Longevity does not provide emergency or urgent care and does not offer 24/7 coverage. If you are experiencing a medical emergency, call 911 or proceed to the nearest emergency department. For mental health crises, call or text 988.
11. Consent
By scheduling and attending a telehealth visit, you acknowledge that you have read and understood this policy, that you consent to receiving care via telemedicine, and that you may withdraw that consent at any time without affecting your right to future in-person care elsewhere.
