HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. Our Legal Duty
WhaleyAP LLC d/b/a Texian Health & Longevity is required by law to maintain the privacy of your protected health information (PHI), to provide you with this notice of our legal duties and privacy practices, and to notify you following a breach of unsecured PHI. We are required to abide by the terms of the notice currently in effect.
2. How We May Use and Disclose Your PHI
Treatment: To provide, coordinate, or manage your care, including sharing information with pharmacies, laboratories, and other providers involved in your treatment.
Payment: To bill and collect payment for services, including through our third-party payment processor.
Health Care Operations: For quality assessment, credentialing, compliance auditing, and business management.
Business Associates: With vendors who perform services on our behalf — including our telehealth platform and electronic medical record vendor — under written HIPAA business associate agreements.
As Required by Law: For public health activities, health oversight, judicial or administrative proceedings, law enforcement requests, prescription monitoring programs, serious threats to health or safety, workers' compensation, and other uses required or permitted by law.
3. Uses Requiring Your Written Authorization
Most uses and disclosures of psychotherapy notes, uses for marketing purposes, and any sale of PHI require your written authorization. You may revoke an authorization at any time in writing, except to the extent we have already acted in reliance on it.
4. Your Rights
- Inspect and obtain a copy of your health records, including an electronic copy.
- Request an amendment to information you believe is incorrect or incomplete.
- Request restrictions on certain uses and disclosures. We must agree to a restriction on disclosure to a health plan for services you paid for in full out of pocket.
- Request confidential communications at an alternative address or by an alternative method.
- Receive an accounting of certain disclosures made in the six years prior to your request.
- Receive a paper or electronic copy of this notice on request.
- Be notified in the event of a breach of your unsecured PHI.
5. How to Exercise Your Rights
Submit requests in writing to the Privacy Officer at the address below. We will respond within the timeframes required by HIPAA, generally within 30 days.
6. Complaints
If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, D.C. 20201, or at hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
7. Changes to This Notice
We may change this notice at any time and make the revised notice effective for all PHI we maintain. The current notice will always be posted on this page with its effective date.
